Collaborators & Freelancers Regulation

1. Scope
This Regulation applies to external individuals and entities collaborating with Avangarde Tourism as freelancers, independent collaborators, consultants, external agents, independent contractors, or similar roles. Access to the platform is conditional on acceptance of this Regulation and, where applicable, the signing of a separate collaboration agreement.
2. Independent status
The collaborator declares that they act independently, on their own account, without an employment relationship, without the legal subordination specific to an employee, and without employee status at Avangarde Tourism. The collaborator organises their activity, time, resources, and working methods under the collaboration agreement, respecting the platform's procedures and quality standards.
3. Eligibility conditions
The collaborator must provide accurate and up-to-date information regarding their identity, form of business, tax details, payment account, experience, and any required authorisations or qualifications. If the activity requires a specific legal form or service contract, the collaborator is responsible for obtaining and maintaining it.
4. No legal representation
The collaborator is not a legal representative, general agent, employee, associate, or partner of Avangarde Tourism. The collaborator may not sign contracts, confirm final bookings, change prices, promise discounts, issue invoices on behalf of the operator, collect money, or assume obligations for Avangarde Tourism without an explicit written mandate.
5. No direct collection
The collaborator is not entitled to request or collect money from clients on behalf of Avangarde Tourism. All client payments must be made through the official methods indicated by the operator. Any breach may result in account suspension, termination of collaboration, withholding of commissions, recovery of damages, and referral to authorities.
6. Permitted activities
Depending on their access level and contract, the collaborator may carry out activities such as:
- Identifying potential clients.
- Initial assistance with completing offer requests.
- Providing general recommendations.
- Promoting approved offers.
- Administrative support, only within authorised limits.
- Other activities approved in writing.
7. Prohibited activities
The collaborator may not:
- Publish unapproved offers or modify the conditions of existing offers.
- Use client data for personal purposes.
- Divert clients or bookings outside the platform.
- Promise non-existent services or unconfirmed conditions.
- Use the Avangarde Tourism brand without authorisation.
- Transmit client data to unauthorised third parties.
- Create fake accounts, fictitious bookings, or fraudulent commission schemes.
- Collect passwords, payment data, or documents without clear instructions.
8. Commission tier system
Eligible collaborators earn commissions from the platform profit generated by offers or bookings attributed to them. The commission is determined by the collaborator's tier. Full details: Agent Commission Level System Annex.

- Commissions are credited with a 2-month delay after the booking is finalised.
- Minimum payout threshold: 100 EUR.
- Payments via bank transfer (EUR/USD) or PayPal in EUR (coming soon).
9. Invoicing and taxes
The collaborator is responsible for their own tax obligations. Commission payment may be conditional on the issuance of an invoice or the provision of required tax documents. Commissions are paid only for finalised, eligible bookings not affected by cancellations, refunds, or chargebacks.
10. Confidentiality & GDPR
The collaborator treats all commercial, technical, financial information and client data accessed as strictly confidential. Personal data processing in the course of collaboration is carried out in accordance with Avangarde Tourism's instructions and the DPA & Confidentiality Annex.
11. Duration and termination
Collaboration may be terminated by either party in accordance with the collaboration agreement. Avangarde Tourism may suspend or revoke platform access in the event of a breach of this Regulation, without further formalities, without prejudice to the right to recover damages.
12. Governing law
Relations between Avangarde Tourism and collaborators are governed by Romanian law and the applicable individual collaboration agreements.
