Agent Commission Level System Annex

Commercial annex to the Collaborators & Freelancers Regulation and, where applicable, the Internal Agents Regulation.
1. Applicability
This Annex applies to agents, independent collaborators, or internal agents for whom Avangarde Tourism expressly activates the right to generate commissions through the platform.
The Annex does not apply automatically to all users, affiliates, suppliers, or employees. Affiliates/vouchers/referrals may have a separate remuneration system, unless it is expressly stated that this Annex applies.
2. Calculation basis
Eligible agents earn commissions from the platform profit generated by offers or bookings attributed to them in the platform.
An Offer may consist of one or more Deals / service components provided by suppliers. Each deal may have a selling price and a platform profit percentage. The platform profit from a deal is calculated as follows:
The platform profit from an offer is the sum of the profits from all its deals.
If a booking generates no platform profit, no commission is owed, unless otherwise expressly agreed in writing.
3. Commission tiers
The commission percentage is determined by the agent's tier, recalculated at the beginning of each calendar month based on the number of completed bookings in the previous calendar month.

4. Bookings that count towards tier
A booking is considered completed only if all of the following conditions are met:
- It has PAID status in the platform.
- The offer end date has passed.
- The tourist services have been delivered or the offer period has ended.
- The booking is attributed to the agent in the platform in accordance with internal rules.
- The booking is not cancelled, refunded, disputed, fraudulent, uncollected, or affected by a chargeback.
- There are no complaints or disputes that could affect collection, profit, or commission eligibility.
Fictitious bookings, self-bookings, bookings created to simulate volume, or bookings generated in breach of platform rules are not eligible and may result in account suspension, cancellation of commissions, and recovery of damages.
5. Tier recalculation
Tiers are recalculated on the first day of each calendar month based on completed bookings in the previous calendar month. Recalculation applies to commissions generated after the recalculation date.
6. Commission crediting
Commissions are credited with a 2-month delay after the booking is finalised, to cover cancellation, refund, complaint, chargeback, and supplier reconciliation periods.
Crediting to the agent account does not necessarily represent actual payment, but the recording of an eligible balance, subject to compliance with this Annex, the absence of cancellations or disputes, and fulfilment of tax/documentation obligations.
7. Minimum threshold and payment methods
A minimum accumulated balance of 100 EUR is required before a payment is made.
Payments are made via:
- Bank transfer in EUR or USD.
- PayPal in EUR — coming soon.
Payment is conditional on providing correct payment details, tax information, and, for independent collaborators, the required invoice or tax document.
8. Cancellations, refunds, and commission recovery
If, after crediting or paying a commission, the booking is cancelled, refunded, disputed, affected by a chargeback, reclassified as ineligible, or identified as fraudulent, Avangarde Tourism may cancel, offset, or recover the relevant commission from future balances or through other means permitted by contract and law.
9. Disputing a calculation
An agent may request verification of a commission calculation within 10 business days of the balance or commission report being displayed. The request must be submitted in writing and must identify the disputed bookings and the reason for the query.
If no dispute is raised within the stated period, the commission report is deemed accepted, except in the case of obvious material errors or fraud/ineligibility discovered subsequently.
10. Modification of the commission system
Avangarde Tourism may modify the commission system, tiers, thresholds, or payment methods with effect for future periods, by updating this Annex and notifying the affected agents/collaborators. Modifications do not affect commissions already credited for eligible bookings.
11. Order of precedence
This Annex supplements the Collaborators & Freelancers Regulation, the Internal Agents Regulation, the applicable individual contract, the commercial annex, and platform procedures. Where there is a conflict between this Annex and an individually signed contract, the individual document prevails, to the extent permitted by law.
