Avangarde Tourism Terms & Conditions

These Terms & Conditions govern access to and use of the Avangarde Tourism platform, available at avangardetourism.com, as well as offer requests, bookings, the use of accounts, and the relationship between users, tourists, collaborators, providers, and the platform operator.

By using the platform, creating an account, submitting an offer request, or completing a booking, the user confirms that they have read, understood, and accept these Terms, to the extent applicable to their role. For certain services, offers, or roles, additional documents may apply, made available before acceptance.

1. Operator details

The Avangarde Tourism platform, available at avangardetourism.com and through any associated digital features, is operated by AVANGARDE TOURISM S.R.L., Tax ID 51421373, registered at the Trade Register under no. J2025016843005, with registered office at Bd. Dacia nr. 43, Bucharest, Romania.

Avangarde Tourism is the commercial name/brand used by the operator for the tourist services offered through the platform.

2. Definitions

For the purposes of these Terms:

“Platform” means the avangardetourism.com website and the associated digital features.

“Operator” or “Avangarde Tourism” means the company indicated in section 1.

“User” means any person who accesses or uses the platform.

“Client” or “Tourist” means the person who requests an offer, creates a booking, purchases tourist services, or travels under a booking.

“Offer” means the commercial proposal displayed on the platform or sent to the client, which may include one or more tourist services.

“Specific offer conditions” means the particular information applicable to an offer: price, included/excluded services, deposit, final payment, cancellation, refund, providers, travel documents, and other relevant conditions.

“Booking” means the request for or confirmation of the purchase of a service or package holiday through the platform or through Avangarde Tourism's official channels.

“Package holiday” has the meaning provided by the applicable legislation on package travel.

“Linked travel arrangement” has the meaning provided by the applicable legislation.

“Internal agent” means the person employed by the operator who uses the platform within the scope of their job duties.

“Independent collaborator” or “external agent” means the authorised individual, company, consultant, or other professional who collaborates with Avangarde Tourism under a separate agreement, without being an employee.

“Affiliate” means the person or entity that promotes the platform's services or brings in clients through referral mechanisms, vouchers, or approved campaigns.

“Provider” means a hotel, carrier, guide, partner agency, local organiser, or other professional that actually delivers tourist or ancillary services.

“Durable medium” means any means that allows the client to store information addressed personally to them in a way accessible for future reference, for example email, PDF, or a user account, provided the information can be retained and reproduced.

3. Platform access, accounts, and roles

The platform may allow the creation of several types of accounts, including client/tourist, collaborator, provider, affiliate, internal agent, or administrator accounts.

The user is responsible for the accuracy of the information provided, for keeping their login credentials confidential, and for using the account only for authorised purposes.

The operator may verify, approve, suspend, or deactivate accounts where there are suspicions regarding incorrect data, unauthorised use, fraud, breach of these Terms, breach of the documents dedicated to the relevant role, or a risk to clients, providers, or the platform.

Collaborator, provider, affiliate, or agent accounts do not automatically grant the right to legally represent Avangarde Tourism. Any right of representation must be granted expressly, in writing, for a specific operation.

4. The role of Avangarde Tourism

Avangarde Tourism's legal role may vary depending on the offer: organiser, intermediary, booking platform, consultant, or another expressly indicated role.

The applicable role must be indicated on the offer page, in the specific offer conditions, and/or in the pre-contractual information provided to the client.

In the absence of an express mention, an offer must not be considered confirmed as a package holiday, intermediated service, or individual service until written confirmation is issued by Avangarde Tourism or by the competent provider/organiser.

5. Services available through the platform

The platform may display, promote, intermediate, or contract tourist services and ancillary services, including accommodation, transport, excursions, tours, city breaks, guiding services, package holidays, customised services, and other services communicated in the offer.

The availability of services may depend on providers, period, capacity, local conditions, travel documents, border rules, weather conditions, or other circumstances beyond the platform's control.

The commercial information displayed must be considered together with the specific offer conditions.

6. Custom offer requests

The user may submit a custom offer request through the forms available on the platform or through Avangarde Tourism's official channels.

Submitting an offer request does not constitute confirmation of a booking and does not guarantee the availability of the services, prices, or conditions initially indicated. Custom offers are valid only within the period and conditions communicated to the client.

By submitting the request, the user asks Avangarde Tourism to process the information provided in order to prepare, send, and discuss a custom offer, in accordance with the Privacy Policy and the conditions applicable to the offer request.

7. Specific offer conditions

Each offer must include or link to its specific conditions, displayed before the booking is finalised. These conditions include, as applicable:

  • the offer name;
  • the offer code;
  • the destination;
  • the travel period;
  • the number of nights/days;
  • the offer type: package holiday, individual service, intermediated service, or linked travel arrangement;
  • the role of Avangarde Tourism: organiser, intermediary, booking platform, or consultant;
  • the organiser and/or the main providers;
  • the total price;
  • the price per person;
  • the currency;
  • the included services;
  • the excluded services;
  • local taxes or additional costs;
  • the deposit;
  • the deadline for final payment;
  • the cancellation conditions;
  • the refund conditions;
  • the modification or transfer conditions;
  • the required travel documents;
  • insurance information;
  • contact details for assistance.

In the event of a difference between these General Terms and the specific conditions of an offer, the specific conditions prevail for that offer, to the extent permitted by law.

8. Prices, taxes, deposit, and payment

The prices displayed or communicated are valid under the conditions and during the period indicated in the offer. Before the booking is confirmed, prices and availability may change as a result of provider updates, exchange rates, taxes, availability, or other commercial factors.

After the booking is confirmed, a price change is permitted only in the cases and within the limits provided by applicable legislation, by the specific offer conditions, and by the contractual documents provided to the client.

Depending on the offer, full payment or payment of a deposit may be required. The deposit percentage, the deadline for final payment, the currency, and the payment methods are displayed before the booking is finalised.

If the final payment is not made by the due date, the booking may be cancelled or the services may be suspended, in accordance with the specific offer conditions, without affecting any non-refundable amounts communicated to the client before booking.

Invoices, receipts, or other fiscal documents are issued in accordance with applicable legislation and the information provided by the client.

9. Official payment methods and unauthorised collections

Payments are made exclusively through the official methods indicated by Avangarde Tourism on the platform, at checkout, in the invoice, or in official communication sent to the client.

Payments made outside the official methods indicated by Avangarde Tourism are made at the client's risk and do not discharge the payment obligation to the operator, except where the person collecting the payment holds an express written mandate from Avangarde Tourism and a valid fiscal proof is issued to the client.

Independent collaborators, affiliates, guides, providers, or other third parties are not authorised to request or collect money from clients on behalf of Avangarde Tourism without an express written mandate.

10. Payment obligation at checkout

If a booking involves a payment, the platform will explicitly indicate this before completion. The client must confirm that they understand that finalising the booking entails a payment obligation in accordance with the conditions of the selected offer.

The booking completion button will be labelled in a clear and unambiguous manner, for example “Confirm booking and pay” or “Book with payment obligation”.

Before the payment button is activated, the client will be shown or provided with:

  • the Terms & Conditions;
  • the specific offer conditions;
  • the total price or deposit due;
  • the final payment deadline, where applicable;
  • the cancellation and refund policy;
  • the applicable pre-contractual information, if the offer constitutes a package holiday;
  • the Privacy Policy.

11. Proof of acceptance of documents

To ensure the traceability of bookings and compliance with information obligations, the platform may store information regarding the acceptance of legal documents and offer conditions, including:

  • the date and time of acceptance;
  • the account or email address used;
  • the IP address;
  • the browser / user agent;
  • the version of the Terms & Conditions accepted;
  • the version of the Privacy Policy;
  • the specific offer conditions accepted;
  • the offer ID and the snapshot of the commercial conditions at the time of booking;
  • the checkboxes ticked by the client.

This information is used to perform the contract, resolve complaints, defend the operator's rights, and comply with legal obligations.

12. Package holidays, linked travel arrangements, and pre-contractual information

For offers that constitute package holidays or linked travel arrangements, the applicable pre-contractual information is made available to the client before the booking is finalised, including the standard form provided by the legislation on package travel.

Depending on the selected offer, the pre-contractual information includes at least:

  • the identity of the organiser and, where applicable, the intermediary;
  • the legal role of Avangarde Tourism;
  • the destination, period, and main characteristics of the services;
  • the included and excluded services;
  • the total price, the currency, the taxes included, and any additional costs;
  • the deposit, the final payment deadline, and the payment methods;
  • the conditions for modification, transfer, cancellation, and refund;
  • the required travel documents;
  • travel insurance information, if available or mandatory;
  • insolvency protection, if applicable;
  • contact details for assistance and complaints.

If the offer constitutes a package holiday, the client benefits from the rights provided by the applicable package travel legislation. If the offer constitutes a linked travel arrangement or an intermediated service, the client is informed of the role of Avangarde Tourism and of the identity of the provider responsible for delivering the service.

The pre-contractual information applicable to each offer must be displayed on the offer page and/or at checkout and provided to the client on a durable medium, usually by email, before or at the latest upon booking confirmation.

13. Booking confirmation and durable medium

A booking is considered confirmed only after the conditions communicated in the offer are met, including acceptance of the applicable documents, payment of the amount due, and confirmation of the availability of the services, as applicable.

The client is sent the booking confirmation and the relevant documents on a durable medium, usually by email and/or in the user account. The confirmation may include: the booked services, the price, the amounts paid, the outstanding balance, the payment deadlines, the cancellation conditions, the travel documents, and the contact details for support.

14. Offer changes, availability, and price

Before the booking is confirmed, offers may be modified or withdrawn depending on availability, providers, prices, local conditions, or material errors.

After the booking is confirmed, changes are made in accordance with the specific offer conditions, applicable legislation, and the documents provided to the client.

If significant changes occur, the client will be informed in good time, through the official channels. The client's rights regarding acceptance of the change, the proposed alternative, cancellation, or refund are those provided by applicable legislation and the contractual documents.

15. Cancellation and refund

The cancellation and refund conditions are set for each offer and are communicated to the client before the booking is finalised. Some amounts may be non-refundable, including deposits, taxes, tickets, confirmed services, or costs imposed by providers, where this is communicated in the offer conditions.

Refunds, where due, are made through the method and within the time frame communicated to the client, taking into account applicable legislation, payment processors, providers, and the nature of the services.

The internal complaints, cancellations, and refunds procedure does not limit consumers' legal rights or travellers' rights provided by the applicable package travel legislation.

Where an offer constitutes a package holiday, the rules on cancellation, refund, unavoidable and extraordinary circumstances, significant changes, and assistance apply in accordance with the special legislation on package travel and the contractual documents provided to the client.

16. Right of withdrawal and cancellation of tourist services

In the case of tourist services, package holidays, or services that involve a specific date or period of performance, the general right of withdrawal applicable to certain distance contracts may be excluded or limited in accordance with applicable legislation.

Cancelling a tourist booking is not the same as the general withdrawal from a distance contract. Cancellation is carried out in accordance with the specific conditions of the accepted offer, the pre-contractual documents, the policy of the providers involved, and the legislation applicable to package holidays or travel services.

The client is informed, before the booking is finalised, of the cancellation conditions, the payment deadlines, and any non-refundable amounts.

17. Travel documents and client obligations

The client is responsible for verifying and obtaining the documents required for travel: identity card, passport, visa, insurance, permits, consents, medical documents, certificates, or other documents required by authorities or providers.

Avangarde Tourism may provide general guidance on travel documents, but final responsibility for the validity and conformity of the documents rests with the client, except where the law provides otherwise.

The client must correctly communicate the data of the persons included in the booking and check the confirmations, tickets, vouchers, and documents provided.

18. Travel of minors

For minors included in a booking, the person making the booking declares that they have the legal right to provide the minor's data and to make the booking on their behalf.

The client is responsible for verifying and obtaining all documents required for the travel of minors, including notarised consents, identity documents, passport, visa, parent/guardian declarations, or any other documents required by authorities, carriers, or providers.

Avangarde Tourism may provide general guidance, but final responsibility for minors' documents rests with the client.

19. Personal data and cookies

Personal data is processed in accordance with the Privacy Policy. The use of cookies and similar technologies is carried out in accordance with the Cookie Policy and the preferences expressed by the user through the consent mechanism available on the platform.

Non-essential cookies, such as analytics or marketing cookies, are used only in accordance with the law and on the basis of the user's consent, where this is required.

20. Commercial communications and newsletter

Commercial communications, newsletters, promotional offers, and marketing messages are sent only in accordance with the law and, where required, on the basis of the user's consent.

The user may withdraw their consent for commercial communications through the mechanisms indicated in the messages received or by contacting Avangarde Tourism.

21. User obligations

The user undertakes to use the platform in good faith, to provide true and current information, and not to use the platform for fraud, spam, abuse, unauthorised access, diverting clients, or infringing the rights of other persons.

It is prohibited to use the platform to transmit false information, make fictitious bookings, carry out unauthorised testing, copy content, automatically extract data, interfere with the platform's security, or carry out any activity that may harm Avangarde Tourism, clients, providers, or collaborators.

22. Agents, collaborators, affiliates, and providers

The platform may include features dedicated to internal agents, independent collaborators, affiliates, and providers. The rights, obligations, commissions, bonuses, vouchers, eligibility conditions, and operational rules applicable to these categories are governed by separate documents, accepted by the persons concerned in the dedicated onboarding flows or in the platform dashboard.

These rules do not affect the price displayed to the tourist and do not create rights or obligations for clients, except where an offer, discount, or voucher is expressly displayed on the offer page or at checkout.

Independent collaborators, affiliates, providers, or other third parties are not employees, legal representatives, or general agents of Avangarde Tourism. They may not confirm final bookings, modify commercial terms, sign contracts, or collect money on behalf of the operator without an express written mandate.

23. Limitation of liability

Avangarde Tourism makes reasonable efforts to ensure that the information displayed on the platform is correct and up to date, but certain information may depend on providers, availability, local regulations, or external circumstances.

Nothing in these Terms limits or excludes Avangarde Tourism's liability for death, personal injury, fraud, wilful misconduct, gross negligence, or other situations where the law does not permit the limitation of liability.

For package travel services, any limitation of damages applies only to the extent permitted by law and without affecting the traveller's mandatory rights.

Avangarde Tourism is not liable for damage caused by incorrect data provided by the client, the absence of travel documents, failure to follow the instructions of providers or authorities, payments made outside the official channels, acts of unauthorised third parties, or circumstances not attributable to it, within the limits permitted by law.

24. Force majeure and unavoidable circumstances

Neither party is liable for the non-performance or delayed performance of obligations where this is caused by events of force majeure, fortuitous events, or unavoidable and extraordinary circumstances, to the extent permitted by law.

Such events may include, without limitation: natural disasters, extreme weather conditions, strikes, conflicts, travel restrictions, pandemics, government actions, decisions of authorities, border closures, major transport disruptions, or other events beyond the parties' control.

For package holidays, the effects of these circumstances are dealt with in accordance with the special legislation applicable to package travel.

25. Intellectual property

The platform's content, including texts, design, structure, graphic elements, logos, photographs, commercial materials, and published documents, belongs to Avangarde Tourism or its partners, as applicable, and is protected by applicable legislation.

The user may not copy, reproduce, distribute, modify, or use the platform's content for commercial purposes without the written consent of the rights holder, except for the normal use of the platform.

26. Complaints, assistance, and dispute resolution

The client may submit complaints or requests for assistance through the official channels indicated on the platform. For efficient resolution, the complaint should include the identification data, the booking number, a description of the situation, supporting documents, and the client's request.

During travel, the client is encouraged to report any non-conformity as quickly as possible, to allow the situation to be remedied. This recommendation does not limit the client's legal rights.

Consumers may approach the competent authorities and may use alternative dispute resolution mechanisms, in accordance with the law. Use of the Avangarde Tourism internal procedure does not limit the consumer's right to approach the competent authorities or courts.

27. Amendment of these Terms

Avangarde Tourism may update these Terms for legal, technical, commercial, operational, or security reasons. Changes may be communicated by email, account notification, or a visible notice on the platform.

The version applicable to a booking is the version accepted at the time the booking was finalised, together with the specific conditions of the accepted offer.

Subsequent changes to the Terms do not affect bookings already confirmed, except where:

  • the change is required by law;
  • the change is necessary to perform the booking;
  • the change is more favourable to the client;
  • the client expressly accepts the change.

28. Applicable law and disputes

These Terms are governed by Romanian law.

For consumers, this clause does not limit the mandatory rights conferred by consumer protection legislation, the rights of travellers provided by the legislation on package travel, or the right to approach the competent authorities, alternative dispute resolution entities, or the competent courts in accordance with the law.

Before initiating a formal procedure, the client is encouraged to submit a complaint to Avangarde Tourism, to allow the situation to be reviewed and resolved amicably.
