1. Introduction

Welcome to Avangarde Tourism (“Company”, “we”, “us”, or “our”). These Terms & Conditions govern your access to and use of our platform at avangardetourism.com and any associated services. By registering an account or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the platform.

2. Definitions

• Platform - the Avangarde Tourism website and all related digital services.
• User - any individual or entity that accesses or registers on the Platform (Tourist, Agent, or Provider).
• Tourist - a user who searches for and purchases travel offers.
• Agent - an Avangarde Tourism employee authorised to create and manage travel offers. Agents earn commissions on bookings based on their monthly Tier level.
• Provider - an external service provider (hotel, airline, etc.) registered on the Platform.
• Offer - a published travel package available for booking, composed of one or more Provider Deals.
• Deal - a service component (e.g. hotel stay, flight, car rental) supplied by a Provider. Each deal has a sell price and a platform fee percentage. The platform’s profit on a deal is the platform fee percentage of the sell price (i.e. sell price × platform fee % ÷ 100).
• Platform Profit - the sum of all deal platform fees within an offer. This is the base for agent commission calculations.
• Finalized Booking - a booking with status PAID whose offer’s end date has passed. Only finalized bookings count toward tier advancement and commission crediting.
• Affiliate Voucher - a voucher code created by an Agent for a specific offer, used to track referrals. It earns the creator a percentage of the agent commission on any resulting booking. Optionally, the agent may configure a tourist-facing discount percentage that is applied at checkout.

3. Account Registration

To access certain features you must create an account. You agree to provide accurate, complete, and current information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials. Avangarde Tourism reserves the right to suspend or terminate accounts that violate these Terms.

Agent accounts are registered at /agent and require email verification only - no secret key or referral link is needed. Provider accounts are subject to verification by our team. Admin accounts are created exclusively by the platform owner and have no public registration endpoint.

4. Services

Avangarde Tourism provides an online platform for browsing, booking, and managing travel packages including but not limited to city breaks, resort stays, cultural tours, and exotic vacations. We act as an intermediary between tourists and travel service providers. The availability and pricing of offers are subject to change without prior notice.

5. Bookings & Payments

All bookings are subject to availability and confirmation by Avangarde Tourism. A booking is considered confirmed only after receipt of the required deposit and written confirmation from us.

• A configurable deposit percentage (set per offer by the agent) may be required at the time of booking. If no deposit is configured, full payment is due at checkout.
• Full payment is due no later than 21 days before the departure date.
• All prices are quoted per person and include applicable taxes unless otherwise stated.
• Children under 2 years of age travel free; children aged 2–12 may be eligible for discounts.

Accepted Payment Methods

• Bank transfer - accepted in EUR, USD, and RON.
• PayPal - accepted in EUR only.
• Credit/debit card - accepted where card payment is available at checkout.

Deposit Payments

• Agents may configure a deposit percentage (between 10% and 90%) per offer. When enabled, clients may choose to pay the deposit at checkout; the balance is due before departure.
• The remaining balance may be settled via bank transfer or directly with the agent. The agent marks the booking as fully paid from the bookings dashboard.
• When a deposit is paid, the platform issues an Advance Invoice. When the agent marks the booking as fully paid, a Balance Invoice is automatically generated for the remainder.
• If no deposit percentage is configured for an offer, full payment is required at checkout.

6. Cancellation & Refund Policy

The cancellation and refund terms vary per offer and are specified in the individual offer details at the time of booking. Please review the refund policy displayed on the offer page before completing your purchase. Cancellation requests must be submitted in writing via email to contact@avangardetourism.com. Avangarde Tourism strongly recommends purchasing travel insurance to cover unforeseen cancellations.

7. Agent Commission Tier System

Agents earn commissions on the platform profit generated by their offers. The commission percentage is determined by the agent’s Tier, which is recalculated at the beginning of each calendar month based on the number of finalized bookings from the previous month.

• Only finalized bookings (PAID status, offer end date passed) count toward tier advancement.
• Tiers are recalculated on the 1st of each month based on the previous calendar month.
• Commission is credited with a 2-month delay after the booking is finalized, to account for cancellation and refund periods.
• A minimum accumulated balance of 100 EUR is required before a payout is issued.
• Payouts are made via bank transfer (EUR/USD) or PayPal (EUR only).

8. Affiliate Vouchers

Agents may create Affiliate Vouchers for their own offers to track referrals and earn a share of their commission. Affiliate vouchers work as follows:

• An affiliate voucher is tied to a specific offer created by the agent.
• When a tourist uses the voucher code at checkout, a discount may or may not be applied depending on whether the agent configured a tourist discount percentage. Without a discount, the voucher serves only as a tracking identifier.
• Agents may optionally configure a tourist-facing discount percentage (1–100%) on an affiliate voucher. When set, this discount is applied to the booking total at checkout.
• Upon finalization of the booking, the voucher creator earns a percentage of the agent’s commission for that booking. This percentage is set by the agent at the time of voucher creation (1–100%, default 50%).
• The affiliate fee is deducted from the agent’s own commission share for that booking.
• Affiliate earnings are subject to the same 2-month delay and 100 EUR minimum payout threshold as regular commissions.

9. User Obligations

You agree not to:

• Provide false or misleading information during registration or booking.
• Use the platform for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the platform.
• Reproduce, distribute, or exploit any content from the platform without written permission.
• Post or transmit any harmful, offensive, or defamatory content.

10. Limitation of Liability

Avangarde Tourism shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform or the travel services booked through it. Our total liability in connection with any booking shall not exceed the amount paid by the user for that specific booking. We are not responsible for force majeure events including but not limited to natural disasters, strikes, government actions, or pandemic-related travel restrictions.

11. Intellectual Property

All content on the Avangarde Tourism platform, including text, graphics, logos, images, and software, is the property of Avangarde Tourism or its licensors and is protected by applicable intellectual property laws. Unauthorised use is strictly prohibited.

12. Modifications to Terms

We reserve the right to update these Terms at any time. Changes will be communicated via email or a prominent notice on the platform. Continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.
