Terms for Suppliers & Tourism Partners

1. Scope
These Terms apply to suppliers and partners providing services through or in connection with the Avangarde Tourism platform: hotels, carriers, guides, local agencies, activity organisers, insurers, transfer providers, restaurants, tour operators, and other service providers.
2. Supplier identity
The supplier must provide accurate and up-to-date information: legal name, address, registration number, tax number, authorised representative, contact details, bank account, authorisations, licences, insurance, and any other documents requested.
3. Representation and authority
The person creating the account or accepting these Terms declares that they have the right to represent the supplier and bind it contractually.
4. Licences, authorisations, and insurance
The supplier declares that it holds all licences, authorisations, approvals, insurance, certificates, and qualifications required for the services provided. The supplier must immediately notify Avangarde Tourism if any authorisation expires, is suspended, or is revoked.
5. Offer publication
The supplier is responsible for the accuracy of information about services, prices, availability, taxes, restrictions, cancellation conditions, photos, ratings, standards, safety, and any relevant limitations.
6. Prices and availability
The supplier must keep prices and availability up to date. If changes, overbookings, or inability to provide services arise, the supplier must immediately notify Avangarde Tourism and propose reasonable solutions.
7. Booking confirmation
Bookings are confirmed under the terms of the commercial contract or platform system. The supplier must honour confirmed services and must not unilaterally change essential elements without the agreement of Avangarde Tourism and, where applicable, the client.
8. Service delivery
The supplier must deliver services to the promised standard, in compliance with applicable law, safety regulations, consumer protection, public health, local rules, and contractual obligations.
9. Complaints
The supplier must cooperate promptly to resolve complaints, provide documents, explanations, and evidence, and bear the costs caused by its own fault, including compensation, alternative services, or refunds.
10. Cancellations and refunds
The supplier's cancellation conditions must be clearly communicated before the offer is published. The supplier may not retroactively modify conditions for already confirmed bookings, except where permitted by law or agreed by the parties.
11. Personal data
The supplier processes client data only for the delivery of confirmed services and must respect data confidentiality, security, and applicable law. The supplier may not use data for its own marketing purposes without a separate legal basis. Full data processing obligations are set out in the DPA & Confidentiality Annex.
12. Access suspension
Avangarde Tourism may suspend or revoke supplier access in the event of incorrect information, expired authorisations, unsatisfactory performance, repeated complaints, or breach of these Terms.
13. Governing law
Commercial relations between Avangarde Tourism and suppliers are governed by Romanian law and the applicable individual commercial contracts.
