1. Operator details
The Avangarde Tourism platform, available at avangardetourism.com and through any associated digital features, is operated by AVANGARDE TOURISM S.R.L., Tax ID 51421373, registered at the Trade Register under no. J2025016843005, with registered office at Bd. Dacia nr. 43, Bucharest, Romania.

2. Scope
These Terms & Conditions govern access to and use of the platform, account creation, submission of custom offer requests, booking of tourist services, payments, cancellations, refunds, communication with the Avangarde Tourism team, and the rights and obligations of users.
By using the platform or ticking the acceptance checkbox, the user confirms that they have read, understood, and accept these Terms. If you do not agree, do not use the platform and do not complete a booking.
3. Definitions
- Platform — the avangardetourism.com website, application, forms, user dashboard, agent/provider dashboard, and any associated digital feature of Avangarde Tourism.
- User — any natural or legal person who accesses or uses the platform, including tourists, clients, agents, collaborators, affiliates, or providers.
- Tourist / Traveller / Client — the person who searches for, requests, books, purchases, or benefits from tourist services.
- Internal Agent — a person employed by the operator, authorised to create or manage offers and bookings within the scope of their role.
- Independent Collaborator / External Agent — an authorised individual, company, professional, or other external collaborator who may support the platform's activity under a separate agreement, without being an employee or legal representative of Avangarde Tourism, except under an express written mandate.
- Provider — hotel, carrier, airline, guide, local organiser, partner agency, insurer, payment processor, or other partner involved in service delivery.
- Offer — the commercial proposal displayed or sent to the client, including destination, period, price, included/excluded services, payment, cancellation, and refund conditions.
- Deal / Service Component — a component of an offer (accommodation, transport, transfer, tour, car rental, or other service supplied by a provider). In the platform's logic, a deal has a selling price and a platform profit percentage.
- Platform Profit — the commercial basis used for commission calculation. Profit per deal = selling price × platform percentage ÷ 100. Offer profit = sum of the profits of its components.
- Finalised Booking — a booking with PAID status whose offer end date has passed and which is not cancelled, refunded, disputed, fraudulent, or affected by a chargeback.
- Affiliate Voucher — a voucher code created for an offer or campaign, used to track referrals and, if configured, to apply a discount at checkout.
- Package Holiday — the combination of travel services that meets the legal conditions applicable to package travel.
4. Platform services and legal role of Avangarde Tourism
Avangarde Tourism provides an online platform for browsing, requesting, booking, and managing travel offers, including city breaks, resort stays, cultural tours, exotic holidays, and other tourist or ancillary services.
Depending on the offer, Avangarde Tourism may act as organising agency, intermediary agency, booking platform, or consultant for custom requests. The exact role for each offer is indicated on the offer page, in the booking confirmation, or in the pre-contractual documents provided to the client.
If the offer constitutes a package holiday, the client benefits from the rights provided by applicable package travel legislation. If the offer is merely intermediated for a third-party provider, the client will be informed of the provider's identity and the role of Avangarde Tourism.
5. User account
For certain features, the user may create an account. The user is responsible for the accuracy of the information provided, for keeping their login credentials confidential, and for all actions carried out through their account.
Tourist/client accounts are created via the public forms available on the platform. Agent/collaborator accounts are created via the dedicated /agent route and may require email verification and additional checks. Provider/partner accounts are subject to verification by the Avangarde Tourism team. Administrator accounts are created exclusively internally and have no public registration endpoint.
Creating an agent, collaborator, provider, or affiliate account does not automatically confer the right to legally represent Avangarde Tourism, confirm final bookings, collect payments, or bind the company towards third parties without an express written mandate.
Avangarde Tourism may suspend or deactivate an account if there are indications of fraud, abuse, false data, breach of these Terms, tax non-compliance, or a security risk.
6. Custom offer requests
Submitting a custom offer request does not constitute a booking and does not create a payment obligation. The request allows the Avangarde Tourism team to review the user's preferences and contact them for clarifications and to send an offer. The offer becomes binding only after availability is confirmed, the offer conditions are accepted, and, where applicable, the deposit or stated price is paid.

7. Bookings and confirmations
The booking process includes: selecting an offer, entering participant details, verifying availability, accepting these Terms and the specific offer conditions, making payment, and receiving confirmation on a durable medium, usually by email.
All bookings are subject to availability and confirmation by Avangarde Tourism and/or the relevant providers. A booking is confirmed only after receipt of the required deposit or payment and after written or electronic confirmation from Avangarde Tourism. A mere request or form submission does not guarantee the availability of services.
8. Prices, taxes, and availability
Displayed prices include the services expressly indicated in the offer. Taxes, costs, and additional services not included will be stated in the applicable offer. Unless otherwise indicated in the offer, prices are per person and include applicable taxes known at the time of the offer.
Offers may contain specific rules for children (for example, free travel for children under 2 or discounts for children aged 2–12) only where such rules are displayed or confirmed for that offer. Prices and availability may change before booking confirmation without prior notice if services have not yet been confirmed.
9. Payments
Payments must be made exclusively through the official methods indicated on the platform, in the invoice/proforma issued, or in official communication from Avangarde Tourism.
Accepted payment methods
- Bank transfer — accepted in EUR, USD, and RON.
- Credit/debit card (VISA, Mastercard via Stripe) — available at checkout.
- PayPal — coming soon, EUR only.
Deposit and final payment
For certain offers, a configurable deposit may be required, generally between 10% and 90% of the price. If no deposit is configured, full payment is required at checkout. Final payment is due at least 21 days before the departure date, unless the offer or contractual documents specify a different deadline.
When a deposit is paid, the platform issues an Advance Invoice. When the agent marks the booking as fully paid, a Balance Invoice is automatically generated for the remaining amount.
Independent collaborators, affiliates, guides, providers, or other third parties are not authorised to collect payments from clients on behalf of Avangarde Tourism without an express written mandate. The client must retain proof of payment. Payment made to an unauthorised person does not discharge the payment obligation to the operator.
10. Payment obligation at checkout
If a booking involves a payment, the platform will explicitly indicate this before completion. The finalise button clearly states the payment obligation.
11. Specific offer conditions
Each offer includes or links to its specific conditions: destination, period, included services, excluded services, price, deposit, final payment deadline, cancellation, refund, penalties, required documents, and other relevant limitations. In the event of a conflict between these General Terms and the specific conditions of an offer, the specific conditions prevail for that offer.

12. Package holidays and pre-contractual information
For offers that constitute package holidays, the applicable pre-contractual information is made available to the client before the booking is finalised, including the standard form on the traveller's main rights, the organiser's identity, included services, total price, payment conditions, modification, transfer, cancellation, refund, and insolvency protection.

13. Travel documents and entry conditions
The client is responsible for verifying and holding the documents required for travel: identity card, passport, visa, parental consent for minors, driving licence, medical documents, insurance, certificates, or other documents required by authorities or providers. Avangarde Tourism may provide general guidance, but final responsibility rests with the client.
14. Data for other persons included in the booking
If the user books on behalf of other persons, they confirm that they have the right to provide their data and have informed them of the booking conditions and the processing of personal data.
15. Booking modification
Modifying a booking is possible only subject to availability, provider conditions, and the offer rules. Additional costs, price differences, or penalties may apply.
16. Cancellation and refund
The cancellation and refund policy is that stated in the accepted offer, pre-contractual documents, and booking confirmation. Unless the offer expressly provides otherwise, cancellations must be communicated in writing to avangardetourism@gmail.com.
Refunds are processed via the original payment method or another method accepted by the operator, after verifying the offer conditions and amounts actually refundable by providers. Avangarde Tourism recommends purchasing appropriate travel insurance.

17. Unavoidable circumstances and force majeure
In the event of external, unforeseeable, or unavoidable circumstances affecting the performance of tourist services (natural disasters, strikes, government actions, travel restrictions, conflicts, health crises, pandemics, major transport disruptions), the parties will apply applicable legal rules and the offer conditions. Avangarde Tourism will inform the client and endeavour to propose reasonable solutions such as rescheduling, alternative services, or a refund.

19. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law, including for death, personal injury, fraud, wilful misconduct, or gross negligence. For package holidays, any limitation of damages applies only to the extent permitted by applicable legislation and without affecting the traveller's mandatory rights.
20. Use of the platform
Users may not use the platform for:
- Fraud, submission of false or misleading data.
- Illegal purposes or unauthorised access.
- Copying or exploiting content without written consent.
- Technical interference, abuse, or spam.
- Publishing or transmitting harmful, offensive, or defamatory content.
- Diverting clients or bookings outside the platform.
21. Content and intellectual property
Texts, graphics, logos, images, software, platform structure, design, databases, offers, and published materials belong to Avangarde Tourism, its licensors, or its partners. Copying, reproducing, distributing, or reusing them without written consent is prohibited.
22. Personal data and cookies
Personal data is processed in accordance with the Privacy Policy. Cookies are used in accordance with the Cookie Policyand the user's stated preferences.
23. Commercial communications
Commercial communications are sent only in accordance with the law and, where required, on the basis of user consent. Users may unsubscribe from marketing communications at any time.
24. Agent commission tier system
Eligible agents earn commissions from the platform profit generated by their offers. The commission is determined by the agent's Tier, recalculated monthly based on the number of finalised bookings from the previous month. Full details: Agent Commission Tier System Annex.

- Commission is credited with a 2-month delay after the booking is finalised.
- Minimum payout threshold: 100 EUR.
- Payouts via bank transfer (EUR/USD) or PayPal in EUR (coming soon).
25. Affiliate vouchers
Agents may create affiliate vouchers for their own offers. Upon finalisation of a booking, the voucher creator earns a percentage of the agent's commission (1–100%, default 50%). The voucher may optionally include a tourist-facing discount (1–100%). Affiliate earnings are subject to the same 2-month delay and validation rules as regular commissions. 26. Amendment of these Terms
Avangarde Tourism may update these Terms. Changes may be communicated by email, account notification, or a visible notice on the platform. The version applicable to a booking is the version accepted at the time the booking was finalised.
27. Applicable law and disputes
These Terms are governed by Romanian law. For consumers, this clause does not limit any mandatory rights conferred by consumer protection legislation, nor the right to approach competent authorities or courts under applicable law. Consumers may also use alternative dispute resolution mechanisms or competent authorities.
